    The Court rejected the respondents’ application to strike out Dickson Holdings Enterprise Company Limited’s petition on the ground that it lacked standing after its shares had been forfeited. It held that the complaint about forfeiture could be determined in the petition. The Court also dismissed the application to stay the remaining dispute in favour of arbitration because the complaint concerned the validity of share forfeiture under the company’s articles and directors’ duties, not a dispute arising out of or relating to the shareholders’ agreement. The respondents’ summons was dismissed, with an order nisi that the first and second respondents pay half of the petitioner’s costs of the application.
