It held that no arbitration clause bound Holding Financière Céleste and Federal State Unitary Enterprise Russian Satellite Communications Company, while the 11 July 2002 tripartite contract contained a jurisdiction clause in favour of the Paris Commercial Court, and remitted the case to the Paris Court of Appeal differently composed. It also ordered RSCC and Orion Satellite Communications Inc. to pay costs and EUR 3,000 to Holding Financière Céleste under article 700 of the French Code of Civil Procedure.
