    The Tribunal held that it had jurisdiction over the dispute under Article VIII(2) of the bilateral investment treaty in combination with Articles X(2) and IV, dismissed the claim based on Article VI, and by majority stayed the arbitration pending determination of the amount due under the CISS Agreement through the contractually agreed forum or agreement between the parties.
