    The Tribunal held that Article 6(4) of the 1996 Romania-Turkey Bilateral Investment Treaty contained Romania's sole standing offer to arbitrate and that the Claimants had not exhausted domestic remedies or submitted the dispute to Romanian courts for one year without a final decision. It therefore declined jurisdiction, without prejudice to the Claimants' right to bring the claims after satisfying those conditions. Each side was ordered to bear its own legal expenses, and the arbitration costs were divided equally.
