I. Yashchuk, in the case on the application of PERSON_1 for recognition and grant of leave to enforce the award of the International Commercial Arbitration of 1 September 2025, rendered by sole arbitrator Tetiana Slipachuk under the UNCITRAL Arbitration Rules 2010, in the case on the claim of PERSON_1 against PERSON_2 for recovery of debt under a sale and purchase agreement

and on the application of PERSON_2 to set aside the award of the International Commercial Arbitration of 1 September 2025, rendered by the ad hoc Arbitral Tribunal composed of sole arbitrator Tetiana Slipachuk under the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL) as revised on 15 September 2010 in the case “PERSON_1 v. PERSON_2 (Ukraine)”,

Guided by Articles 24, 367, 368, 374, 375, 381-384, 459, 477, 479 of the Civil Procedure Code of Ukraine, the Supreme Court, composed of a panel of judges of the First Judicial Chamber of the Civil Cassation Court,

RESOLVED:

To dismiss the appeal of PERSON_2, on whose behalf attorneys Anna Kostiantynivna Kozyrieva and Olena Serhiivna Perepelynska act.

To uphold the ruling of the Kyiv Court of Appeal of 25 May 2026.

The resolution of the court of appeal instance enters into legal force on the day of its adoption and is not subject to appeal.
