The Supreme Court, sitting as a panel of judges of the First Judicial Chamber of the Civil Cassation Court:

applicant: private enforcement officer of the enforcement district of the city of Kyiv Vladyslav Hennadiiovych Tatarchenko;

judgment creditor: Himbalt Trade OU (Republic of Estonia);

judgment debtor: Mega Grupp Limited Liability Company (Ukraine);

interested party: Ukrplatinum Limited Liability Company (Ukraine);

with the participation of:

the representative of the interested party, attorney Andrii Oleksandrovych Soldatov,

having considered in an open court hearing on the premises of the Supreme Court (Kyiv, 28 Povitrianykh Syl Avenue) the case on the application of the private enforcement officer of the enforcement district of the city of Kyiv Vladyslav Hennadiiovych Tatarchenko against Ukrplatinum Limited Liability Company for levying execution on funds belonging to a person indebted to the judgment debtor, in the case on the application of Himbalt Trade OU (Republic of Estonia) for recognition and leave to enforce the award of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry of 30 May 2025 in arbitration case No. 432/2024 on the claim of Himbalt Trade OU (Republic of Estonia) against Mega Grupp Limited Liability Company (Ukraine) for recovery of debt, upon the appeal of Ukrplatinum Limited Liability Company against the ruling of the Kyiv Court of Appeal of 9 December 2025 rendered by Judge O. V. Zhelepa,

ESTABLISHED:

In view of the complexity of the case and the time required to prepare the full text of the resolution, the panel of judges considers it possible and appropriate to pronounce the introductory and operative parts of the resolution.

Guided by Articles 10, 24, 255, 351, 367, 368, 374, 379, 381-384 of the Civil Procedure Code of Ukraine, the Supreme Court, sitting as a panel of judges of the First Judicial Chamber of the Civil Cassation Court,

RESOLVED:

To allow in part the appeal of Ukrplatinum Limited Liability Company.

To set aside the ruling of the Kyiv Court of Appeal of 9 December 2025 and to remit the case to the court of first instance for further consideration.

The resolution of the appellate court shall enter into legal force upon its adoption, is final and is not subject to appeal.
